Agreement to Terms

By accessing or using OliveCare ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service.

Eligibility

You must be at least 18 years of age to use OliveCare. If you are under 18, you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

By using OliveCare, you represent and warrant that you meet these eligibility requirements. If you are using the Service on behalf of another person (such as a care recipient), you represent that you have the legal authority to agree to these Terms on their behalf.

Description of Service

OliveCare is a medication management application that helps users track medications, set reminders, and share information with caregivers. The Service is intended for personal, non-commercial use.

Medical Disclaimer

OliveCare is not a medical device and does not provide medical advice. The Service is designed to help you track and remember your medications, but it is not a substitute for professional medical advice, diagnosis, or treatment.

Always consult your physician or qualified healthcare provider with any questions about your medical condition or medications. Never disregard professional medical advice or delay seeking it because of information from OliveCare.

Service Limitations and No Guarantee of Reliability

OliveCare is a supplementary tool only and should not be relied upon as the sole means of ensuring medication adherence.

We do not guarantee the timeliness, accuracy, or reliability of:

  • Notifications or reminders being delivered on time or at all
  • Real-time updates to caregivers about medication being taken
  • Synchronization of data between devices or users
  • The accuracy of user-logged medication records

Users are responsible for correctly logging their medication intake. OliveCare cannot verify whether a user has actually taken their medication—we can only record what users report. Caregivers should not rely solely on OliveCare to monitor an individual's medication compliance and should maintain other means of communication and verification.

Technical issues, network connectivity problems, device settings, or other factors outside our control may affect the delivery of reminders and the synchronization of data. You acknowledge that missed reminders or delayed updates may occur, and OliveCare shall not be held liable for any consequences resulting from such occurrences.

For critical medication schedules, always use additional safeguards such as pill organizers, in-person check-ins, or professional care services.

User Accounts

When you create an account, you agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Share your account with others
  • Attempt to access other users' data
  • Reverse engineer or modify the application
  • Use the Service to transmit harmful content
  • Interfere with the proper functioning of the Service
  • Use the Service for commercial or professional purposes without authorization

Device Requirements

You may not use OliveCare on a device that has been jailbroken, rooted, or otherwise modified to remove manufacturer security restrictions. Such modifications can compromise the security of your device and personal data, leaving you vulnerable to unauthorized access or malicious attacks.

We cannot guarantee that OliveCare will be compatible with all devices, operating systems, or software versions. We do not guarantee uninterrupted functionality and are not obligated to provide technical support for compatibility issues with specific devices or configurations.

Caregiver Features

By using caregiver sharing features, you consent to share your medication information with designated individuals. You are responsible for managing who has access to your information and can revoke access at any time.

License and Intellectual Property

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the OliveCare application on devices you own or control, solely for your personal, non-commercial use.

The Service and its original content, features, and functionality are owned by OliveCare and are protected by international copyright, trademark, and other intellectual property laws. All rights not expressly granted in these Terms are reserved.

You may not copy, modify, distribute, sell, lease, or create derivative works based on the Service without our prior written consent.

Limitation of Liability

To the maximum extent permitted by applicable law, OliveCare and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of data, revenue, profits, or business opportunities
  • Personal injury or property damage related to your use of the Service
  • Any health-related consequences arising from missed medications, incorrect dosages, or reliance on the Service for medical decisions
  • Unauthorized access to or alteration of your data
  • Any failure or delay in delivering notifications or reminders
  • Actions taken or not taken based on information provided through the Service

We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. You use the Service at your own risk.

In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability shall be limited to the maximum extent permitted by law.

Data and Account Termination

You are solely responsible for maintaining backups of any data you enter into OliveCare. We are not liable for any loss of data resulting from:

  • Your deletion of data or your account
  • Uninstallation of the application from your device
  • Loss of access to your account credentials
  • Technical failures, device malfunctions, or other circumstances beyond our control

We may terminate or suspend your account at any time for violation of these Terms or for any other reason at our discretion. We may also terminate accounts that have been inactive for an extended period (24 months or more) after providing notice to the email address associated with your account.

Upon termination, your right to use the Service will immediately cease, and we may delete your account data. We are not obligated to retain or provide copies of your data after termination.

Changes to Service

We reserve the right to modify or discontinue the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which OliveCare operates, without regard to conflict of law principles.
